How selection works changed from FY 2027

From the FY 2027 cap season, H-1B registrations are no longer selected by a uniform random lottery. A DHS final rule effective February 27, 2026 introduced a weighted selection process that generally favours higher-paid registrations, while keeping registrations at all wage levels eligible. Because selection odds now depend on the offered wage relative to Department of Labor wage levels, a single blended selection rate does not describe an individual registrant's chances. Check your own wage level and the current USCIS announcement.

Selection rate = selected ÷ eligible registrations, on a registrations basis for every year shown. FY 2026 was the final season selected by uniform random lottery. On a unique-beneficiary basis FY 2026 was 118,660 of 336,153 (~35.3%) — a different denominator, so do not compare the two bases directly. Odds also vary by cap type (regular 65k vs. advanced-degree 20k exemption).
